1. Who We Are

smell100 is a social media platform for fragrance discovery and community tracking.

2. Access and Account Registration

To use certain features of smell100 (like reviewing), you must create an account.

• Eligibility: You must be at least 16 years old to create an account.
• Account Security: You are responsible for keeping your password secure. If you suspect unauthorized use of your account, please notify us immediately.
• Accuracy: You agree to provide current and accurate information.

3. Your Content and Rights

We love seeing your reviews and lists! Here is how we handle what you post:

• Ownership: You retain full ownership of the reviews, comments, and other content you post on smell100.
• License to Us: By posting, you grant smell100 a non-exclusive, worldwide, royalty-free license to display, reproduce, and translate your content on our platform (and in our marketing materials).
• Community Rules: You agree not to post content that is illegal, defamatory, hate speech, or spam.
• Content Removal: In accordance with EU regulations (like the Digital Services Act), we reserve the right to remove content that violates these terms or is flagged as illegal. We will act promptly if we are notified of such content.

4. Our Intellectual Property

Except for the content posted by users, smell100 owns all rights to the website design, database structure, logo, and code. You may not copy, scrape, or reverse-engineer smell100 without our written permission.

5. Liability and Warranties (EU Standard)

We work hard to ensure smell100 is accurate and available, but we cannot guarantee it will always be perfect.

• Service Quality: We provide the service with reasonable care and skill. However, we do not guarantee that the database is free of errors or that the site will be uninterrupted.
• Third-Party Links: We are not responsible for the content of external websites linked on our platform.
• Limitation of Liability:
  • We are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill.
  • We are not responsible for any loss or damage that is not foreseeable, nor for any business losses (such as loss of profit or revenue).
  • Note: Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud, as required by EU law.

6. Data Protection

Your privacy is critical. We process your personal data in compliance with the General Data Protection Regulation (GDPR). Please read our Privacy Policy to understand your rights regarding your data.

7. Termination

You may delete your smell100 account at any time via your settings. We may suspend or terminate your access if you materially breach these terms (e.g., by posting spam or abusive content), but we will generally provide you with a reason unless legally prohibited.

8. Dispute Resolution

If you have a problem, we want to fix it. Please contact us at weare@smell100.com first.

• ODR Platform: If you live in the EU/EEA and we cannot resolve a dispute, you may use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
• Governing Law: These Terms are governed by the laws of the Republic of Slovenia. Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent court in Maribor, Slovenia.

9. Changes to These Terms

We may update these terms as smell100 grows. If we make significant changes that affect your rights, we will notify you in advance (e.g., via email or a site notification).
